On the evening of October 31, 2024, after receiving a tip from a security company contracted by a local church, Frederick Police officers took steps to help secure a community event in response to safety concerns. The security team notified officers that David Michael Beers (DOB: 2/15/1975), a known individual who previously exhibited aggressive behavior, had made concerning statements about the church, which was hosting an event at Baker Park that evening.
Around 6:00 p.m., Frederick Police officers were conducting patrol checks near 200 W Second Street when they observed Mr. Beers in attendance. With the assistance of security personnel, officers identified what appeared to be a firearm in Beers’ possession. Upon investigation, officers discovered a “Byrna LE” pellet gun in his waistband. This weapon closely resembles a firearm and lacks distinctive markings to indicate otherwise, potentially causing alarm to the public.
Although this weapon is not classified as a firearm, it is regulated under the recently enacted Frederick City Code 33.2, which prohibits the carrying or display of imitation firearms, including pellet guns, in public spaces.
Per the ordinance, individuals may not “possess, wear, carry, display, or transport any gun… in any public place… or in any bag, backpack, vehicle, or other article which may conceal the air gun, airsoft gun, BB gun, imitation firearm, paintball gun, pellet gun, or replica gun.” In adherence to this code, Mr. Beers was detained, searched, and subsequently arrested for two counts of violating the City Ordinance. A second, loaded “Byrna” device and additional magazines were located in his vehicle.
Mr. Beers was transported to the Frederick County Adult Detention Center and is currently held without bond.
